Professional Refund Policy
Payments made to Soul Archive reserve professional time, strategic attention, creative production capacity, technical planning, and delivery availability. Because digital agency work often begins before a visible final file is produced, refunds are assessed according to the stage of work completed, the resources already allocated, and the commercial value of planning, consultation, design direction, copywriting, code, research, or software architecture already delivered.
Before production begins, a partial refund may be considered on a case-by-case basis. Any approved refund may deduct consultation time, discovery work, scheduling costs, administrative handling, payment processing fees, planning documents, early creative direction, and any third-party costs incurred for the project. A request made after the client has received strategic recommendations, wireframes, copy drafts, design concepts, technical direction, or implementation work will be evaluated as a partially performed service.
Once design, development, content strategy, SEO research, software planning, interface work, or implementation has started, payments are generally non-refundable. This is because the work is custom, time-based, and specific to the client's business, even when the client later decides not to use the delivered material. Revisions, refinements, or adjustments within the agreed scope are normally the appropriate remedy instead of a refund.
Monthly retainers, SEO engagements, advisory arrangements, and ongoing support services are billed for access to capacity and professional availability during the active billing period. Unused hours, missed client feedback windows, delayed asset delivery, or lack of client response do not automatically create a refund entitlement when Soul Archive has remained available to perform the agreed work.
If Soul Archive is unable to deliver the agreed scope due to an internal reason, a fair remedy may include revised delivery, a corrected deliverable, a project credit, an adjusted timeline, or a partial refund proportional to the undelivered work. Refunds are not intended to cover indirect losses, lost revenue, third-party platform issues, hosting problems, domain provider delays, rejected app store decisions, or business outcomes that depend on market conditions outside Soul Archive's control.
All refund requests must be submitted in writing to devbhanshali@devilsense.com with the client name, project name, payment date, service purchased, and reason for the request. The Soul Archive operations team will review the request professionally and respond with the available remedy based on the project record and completed work.
Cancellation Policy
Clients may request cancellation by emailing devbhanshali@devilsense.com with the project name, service, payment reference, and reason for cancellation. The effective cancellation date is the date Soul Archive receives the written request. Verbal comments, informal messages, delayed feedback, or failure to provide materials do not automatically cancel a project unless confirmed in writing.
Work completed before cancellation remains billable. This includes discovery sessions, consultation, project planning, research, creative direction, copywriting, interface design, technical architecture, code, SEO analysis, content strategy, project management, and any drafts or deliverables prepared before the cancellation request. A cancellation does not remove the client's responsibility to pay for work already performed or capacity already reserved.
If a fixed-scope project is cancelled after production has started, Soul Archive may close the engagement, pause the project, or offer a revised scope depending on the work completed and the client's needs. Any eligible remaining balance may be converted into project credit at Soul Archive's discretion, provided the client resumes within a reasonable time and the original scope remains technically and commercially viable.
Monthly services such as SEO retainers, technical support, advisory services, or ongoing content arrangements may be cancelled before the next billing cycle. Work already started in the active billing period is not retroactively cancelled. To avoid renewal, cancellation should be sent before the next scheduled billing date and with enough time for administrative processing.
Client delays can affect cancellation and scheduling. If requested assets, approvals, passwords, hosting access, feedback, brand materials, or content are not provided on time, Soul Archive may pause the project timeline. A paused project may require rescheduling, and resumption may depend on current availability. Extended inactivity may be treated as project abandonment if the client does not respond after reasonable follow-up attempts.
Cancellation does not transfer ownership of incomplete concepts, unused drafts, internal notes, strategy documents, code experiments, rejected designs, or production files unless specifically included in the paid deliverables and released by Soul Archive. Final handoff remains subject to payment completion and the agreed scope.
Terms & Conditions
By engaging Soul Archive, the client agrees to provide accurate business information, timely feedback, required assets, access credentials, written approvals, brand materials, and any other inputs needed to complete the agreed scope. The client is responsible for ensuring that materials provided to Soul Archive, including text, images, logos, trademarks, data, and third-party content, may lawfully be used in the project.
Project timelines depend on client responsiveness, scope clarity, asset availability, technical requirements, third-party platform behavior, and approval speed. Estimated delivery dates are provided in good faith but may change if the client requests revisions, changes direction, expands scope, delays feedback, changes priorities, or fails to provide required materials. Soul Archive will make reasonable efforts to communicate timeline changes clearly.
The agreed scope defines the deliverables. New features, additional pages, extra integrations, expanded copywriting, advanced animations, custom software modules, SEO deliverables, additional revision rounds, migration work, troubleshooting beyond the agreed environment, or support outside the original project description may require a separate quote or written approval before work continues.
Unless otherwise stated in writing, final ownership of approved custom deliverables transfers to the client after full payment is received. This does not include Soul Archive's pre-existing intellectual property, internal methods, reusable components, general knowledge, development techniques, open-source libraries, third-party tools, licensed assets, code frameworks, or proprietary lab concepts. Third-party software remains subject to its own license terms.
Soul Archive may retain the right to display completed work, project visuals, non-confidential outcomes, and public-facing deliverables in its portfolio, proposals, social channels, or marketing materials unless a separate written confidentiality agreement prohibits that use. Confidential information shared by the client will be treated with professional care and will not be intentionally disclosed outside the needs of project delivery.
The client is responsible for reviewing and approving final deliverables before launch or publication. Once approved, Soul Archive is not responsible for errors that were present in approved copy, client-provided materials, third-party account settings, hosting limitations, domain configuration, plugin changes, or external services outside Soul Archive's control. Post-launch support, maintenance, monitoring, or updates may require a separate agreement.
Digital performance outcomes such as sales, rankings, traffic, conversion rates, user adoption, revenue, or engagement cannot be guaranteed. Soul Archive provides professional strategy, design, development, SEO, and content services designed to improve the quality and clarity of a digital presence, but market response depends on the offer, audience, competition, budget, timing, and other external factors.
These terms are provided as professional operating boilerplate for Soul Archive services and may be updated as services evolve. Continued use of Soul Archive services after updated terms are published or provided will be treated as acceptance of the revised terms unless a separate written agreement states otherwise.
